1. About us
This website is operated by DON DULCE PTY LTD, ABN ABN 60 702 615 905 trading as Don Dulce, trading as Don Dulce (“we”, “us” and “our”).
These terms apply to purchases through our online store and your use of our website. Please read them before placing an order.
2. Your consumer rights
Our products come with consumer guarantees under Australian Consumer Law. Nothing in these terms or our other policies excludes, restricts or modifies rights or remedies that cannot lawfully be excluded.
If another provision in these terms conflicts with those rights, your statutory rights take priority.
3. Products and availability
We aim to provide accurate product descriptions, images, prices and availability information. Colours may appear slightly different on different screens.
Please check each product description for its size, quantity and included items. Food styling and serving suggestions shown in photographs are not included unless expressly listed.
We may update our range and listings for future purchases. We will not substitute products or materially change the contents of an existing order without your agreement.
Limited-edition products and bundles are available while stocks last.
4. Prices and payment
All prices are in Australian dollars (AUD) and include GST where applicable.
Shipping costs are displayed at checkout before you complete your purchase. Prices may change for future orders, but price changes do not retrospectively change an accepted order.
Payment is required when ordering, using one of the methods available at checkout. You must be authorised to use your selected payment method.
Payments are processed through our payment providers.
5. Orders and acceptance
Please check your products, quantities, contact details and delivery address before placing your order.
Your order is an offer to purchase the selected products. The initial order confirmation email acknowledges receipt of your order. We accept your order when we send a dispatch confirmation.
Before acceptance, we may decline an order where stock is unavailable, there is a genuine pricing or listing error, payment cannot be verified, or we reasonably suspect fraud or unlawful activity.
If an issue arises, we will contact you promptly. We will not charge a higher price or substitute products without your agreement.
If we cancel an entire order, we will refund all amounts paid for that order, including shipping. If only part of an order cannot be supplied, we will contact you about the available options and refund any items not supplied and any shipping overcharge.
6. Order changes and cancellations
If you need to change or cancel an order, contact us as soon as possible.
We will try to assist, but changes and change-of-mind cancellations may not be possible once packing or dispatch has begun.
This does not limit any cancellation or refund rights you have under Australian Consumer Law.
7. Shipping and delivery
We aim to pack and dispatch orders within 1–2 business days, excluding weekends and public holidays in Victoria.
Delivery time after dispatch depends on your address and whether you select Australia Post Standard or Express shipping. Express shipping does not shorten the packing and dispatch period.
Delivery timeframes are estimates. If we become aware of a significant delay, we will notify you.
Please contact us if your parcel is delayed, missing or damaged so we can investigate with the delivery provider and arrange an appropriate resolution. Your consumer rights continue to apply.
If you notice an incorrect delivery address, contact us immediately. If additional delivery costs arise solely because you supplied an incorrect address, we will explain those costs and obtain your agreement before arranging redelivery.
8. Returns and refunds
We do not accept change-of-mind returns or exchanges on food products, bundles or limited-edition PR boxes.
If your order is damaged, faulty, incorrect or incomplete, please contact us as soon as you discover the issue. Include your order number or other proof of purchase, a description of the issue and photos where possible.
For a product quality concern, the batch number and best-before date can help us investigate.
We will assess the issue and provide the remedy required by Australian Consumer Law. Please see our Returns & Refunds Policy for further details.
Contact us before posting products back so we can advise on the appropriate next steps.
9. Ingredients, allergens and storage
Please review the ingredients and allergen information before purchasing and check the packaging before consuming. If you have a dietary question that is not answered by the product information, contact us before ordering.
Follow the storage instructions and best-before information on the packaging. Our dulce de leche must be refrigerated after opening, with the lid tightly closed. We also recommend refrigerating it upon arrival if you prefer to enjoy it chilled.
Do not consume a product you suspect is unsafe or that arrives with damaged packaging affecting its safety. Contact us for assistance.
10. Using our website
You must not use our website for fraud or unlawful activity, submit false order information, interfere with its operation or attempt unauthorised access to our systems.
We may restrict access where reasonably necessary to protect the website or prevent misuse. This does not remove our obligations in relation to existing orders.
We may temporarily suspend the website for maintenance, updates or security reasons.
11. Website content and intellectual property
Content on this website is owned by Don Dulce or used with permission, unless otherwise identified.
You may browse and use the website for personal shopping purposes. Commercial copying or reuse of our content requires permission, except where otherwise permitted by law.
12. Reviews and customer content
Reviews must reflect genuine experiences and must not contain misleading, unlawful or infringing material.
By submitting a review for publication, you permit us to display it on our website with the name you choose to provide. Any formatting edits will preserve its meaning.
We will seek your permission before using customer photographs, videos or private messages in promotional materials.
We may remove spam, unlawful content or content that breaches these requirements. We will not remove a genuine review solely because it is negative.
13. Privacy and external services
Our Privacy Policy explains how we collect, use and handle personal information.
Our website may link to external websites or services with their own terms and privacy policies. We do not control those external websites. Using payment, delivery or other service providers does not remove our responsibilities to you under Australian Consumer Law.
14. Responsibility and disputes
Each party remains responsible for its acts and omissions as provided by applicable law. These terms do not require you to indemnify us for our own negligence or wrongdoing.
If you have a concern about an order or these terms, please contact us so we can try to resolve it.
These terms are governed by the laws of Victoria, Australia, subject to any mandatory consumer laws that apply to you. Nothing prevents you from exercising your rights through a court, tribunal or consumer authority with jurisdiction.
15. Changes to these terms
We may update these terms by publishing a revised version with an updated date.
The terms in effect when you placed your order will continue to apply to that order unless we agree otherwise with you or a change is required by law.
